Beyond Behavioral Compliance: Decision Architecture and the Decision-Making Process in Building Compliance Cultures

Abstract

This article proposes a conceptual approach to compliance from a cognitive perspective, exploring how decision-making processes influence the building of compliance cultures within organizations. Drawing on contributions from cognitive psychology, behavioral economics, and organizational theory, it argues that the traditional approach to compliance—centered on rules, controls, and sanctions—is insufficient to explain organizational behavior regarding regulatory compliance. In this regard, the study posits that observable behaviors constitute only the final manifestation of deeper cognitive and decision-making processes, conditioned by factors such as decision architecture, organizational incentives, contextual pressures, and cognitive biases. From this perspective, the paper proposes expanding the scope of compliance to include the analysis and design of the decision-making processes that precede organizational behavior, viewing decision architecture as a key element for strengthening institutional integrity and sustainably promoting cultures of compliance within organizations.
